Johnny White, Esq.

JOHNNY WHITE grew up in South Florida and joined Pozo-Diaz & Pozo, P.A. in 2013.  He actively litigates in state circuit and county courts, representing clients in construction defect claims, medical and professional malpractice, commercial litigation, general liability, contract disputes, premises liability, personal injury, nursing home, automobile negligence, slip/trip and falls, negligent security, defamation, bad faith and coverage disputes.  Johnny has become known for crafting creative solutions to complex issues, his practice increasingly involves construction industry issues and he has gained extensive experience defending construction defect claims. His construction experience includes claims relating to single-family residences, as well as claims involving large multi-unit residential and commercial developments. Over the years, he has resolved complex matters throughout Florida, representing property owners, architects, various sub-contractors, construction managers, developers, general contractors, municipalities and specialty contractors. Johnny has successfully resolved many multi-million dollar disputes on behalf of construction industry clients throughout Florida.  Johnny has also settled many complex cases without the need for trials and has extensive experience in handling matters in pre-suit, and both mediation and arbitration, examples include:

Commercial Buildings: Defended claims involving defective construction of commercial property, including environmental issues, tenant improvements, and issues involving surety and performance bonds
Condominium Projects: Defended and coordinated negotiation of multi-party claims involving defects in large condominium complexes. Worked with homeowner association, developer, and subcontractor counsel in addition to experts in multiple trades to negotiate scope of defect, method, and cost of repairs
Mold issues: Defended claims involving mold from both a construction defect and personal injury perspective
Residential Property: Defended cases involving issues of defective construction of single-family residences, including roof, drainage, soils, foundation, water intrusion, plumbing, stucco, masonry, electrical, and a myriad of other alleged defective conditions
Insurance Defense – Defended numerous claims including hurricane and windstorm damage, water intrusion resulting from defective workmanship, storm related events, drain pipes, sewage back-ups, window system failures, exterior building envelope penetrations, roofing membrane failures and lack of maintenance, fire damage and various other forms of consequential property damage and personal injury matters involving various alleged torts.

Johnny graduated from St. Thomas University School of Law, in Miami, Florida. Johnny graduated from Florida State University with a Bachelor of Science in Political Science and Business.  He is a member of The Florida Bar, Federal Bar for the Southern District of Florida and Dade County Bar Association. Mr. White has also earned an AV® Peer Review Rating, which is the highest Martindale Hubbell rating available to an attorney. Ralph A. Suarez, Esq.

RALPH A. SUAREZ was born and raised in the South Florida area and joined Pozo-Diaz & Pozo, P.A., in the fall of 2010. He completed his undergraduate studies at Florida State University, where he received a Bachelor of Science in Criminology as a member of Lambda Alpha Epsilon, the American Criminal Justice Association.

Mr. Suarez then obtained a Juris Doctor degree from St. Thomas University School of Law. During his time at St. Thomas, he served as Vice President of the Hispanic American Law Society and was recognized for his work as an articles writer by the Women Lawyers Division of the National Bar Association.

Mr. Suarez was admitted to the Florida Bar in 2007 and practices in the areas of insurance defense litigation, with particular emphasis on personal injury; premises liability; construction and design defects; automobile liability; products liability; and negligent security. He has been trained in pre-suit accident investigation and full file responsibility from inception through trial. He joined the firm in order to help serve its expanding client base in all practice areas while providing professional service and achieving positive results. Mr. Suarez is also admitted to practice in the Federal Bar for the Southern District of Florida.

Martha Pozo-Diaz, Esq.

MARTHA POZO-DIAZ is a native of South Florida who resides in Coral Gables, Florida.  She began her legal career after receiving her Juris Doctorate Degree from the University of Miami, School of Law in Coral Gables, Florida. She received her Bachelor’s degree in Accounting from the University of Miami.   She focuses her practice in the areas of real estate and business law.

She has extensive experience in residential and commercial real estate transactions including the representation of banking institutions and lenders, home builders and developers, as well as individual clients.  She manages the entire transactional and documentation cycles for buyers and sellers, real estate developers and private and institutional lenders. She represents commercial and private lenders in connection with the structuring of new asset-secured loans and construction financing, the negotiation and preparation of initial loan commitment letters, the review of title on behalf of the lenders, the preparation of loan documentation and the closing of the loan transactions.  She has worked with Lenders regarding due diligence activities, workout and disposition activities.

We have represented a diverse client base in every facet of real estate transactions, contracts and legal matters. Our real estate clients include property owners, property managers, landlords, tenants and lenders, and we counsel and represent them in every aspect of transactional real property law.   Her services include: the acquisition, development and disposition of real property; commercial, office, industrial, restaurant and shopping center lease negotiation and enforcement; mortgage finance and workouts; multi-family and condominium developer representation; title insurance; drafting, negotiation and enforcement of all types of real property contracts and agreements; and commercial & residential landlord tenant disputes.

Ms. Pozo-Diaz was appointed by Coral Gables City Commissioner Ralph Cabrera to the City of Coral Gables Property Advisory Board in June 2005 and completed two terms in May 2009.  She is title agent for Old Republic National Title Insurance Company and Fidelity National Title Insurance Company. Ms. Pozo-Diaz is fluent in Spanish.
